Cycling Couture Loyalty Program
“Anniversary” means 12 months from a Member’s Join Date
“Customer” means individuals who have purchased through Cycling Couture’s Website store.
“Effective Date” means 01 Oct 2018;
“Join Date” means the date a Member joins the Cycling Couture Loyalty Program.
“Member” means individuals who sign up as a Customer through an online purchase and who are automatically added to the Cycling Couture Loyalty Program.
“Member Emails” means emails that are sent from Cycling Couture to a Member including emails about the individual’s membership, the Cycling Couture Loyalty Program, special offers, discounts, competitions and events.
“Loyalty Program Terms and Conditions” means these terms and conditions as amended from time to time.
“Cycling Couture” means Pty Ltd ABN 40607059316 and its related entities and its authorised representatives.
“Cycling Couture Loyalty Program” means the loyalty program operated by Cycling Couture providing Members with access to Rewards in accordance with these Loyalty Program Terms and Conditions.
“Points” means rewards or other benefits given to Members as a consequence of purchasing behaviours, incentives and/or promotions.
“Valid Purchases” means all purchases except gift cards, delivery costs, and selected merchandise which Cycling Couture determines will not be eligible to earn Points. Any purchases which are returned will not constitute Valid Purchases.
“Website” or “Online Store” refers to the Cycling Couture website cyclingcouture.cc where details of the Cycling Couture Loyalty Program (including the most up to date Terms and Conditions) can be found and where Members can monitor their Points status and balance.
General Loyalty Program Terms and Conditions
These Loyalty Program Terms and Conditions document the operation of the Cycling Couture Loyalty Program and any promotional activity and loyalty transactions that arise as a consequence of the Cycling Couture Loyalty Program.
Individuals who join the Cycling Couture Loyalty Program agree to be bound by these Loyalty Program Terms and Conditions.
The Loyalty Program Terms and Conditions may be modified at any time without prior notification by Cycling Couture in its absolute discretion. Any modification to the Loyalty Program Terms and Conditions may be applied to a Member retrospectively.
Cycling Couture will not accept any liability for any Member Email that is misdirected, lost or not received.
Cycling Couture will not accept any liability for any Technical Issues that may cause damage to any computer related to or used in connection with the Cycling Couture Loyalty Program.
Cycling Couture reserves the right to cancel, terminate, modify or suspend the Cycling Couture Loyalty Program or any aspect of it.
Cycling Couture may, at any time and in its absolute discretion, require a Member to provide to Cycling Couture proof of identification (in a form requested by Cycling Couture) for Cycling Couture to verify the authenticity of a Member’s membership and compliance with the Loyalty Program Terms and Conditions. Failure to provide proof of identification may result in termination of a Member’s involvement in the Cycling Couture Loyalty Program.
Cycling Couture will not be liable for any tax liability incurred by a Member in connection with the Cycling Couture Loyalty Program, including that incurred in the provision and/or utilisation of Points.
These Member Terms and Conditions are to be read in conjunction with the Website Terms and Conditions and other relevant Cycling Couture policies and or terms and conditions.
Cycling Couture’s decision in relation to all matters arising in relation to the Cycling Couture Loyalty Program is final and binding.
Reference to a ‘day’ in these Loyalty Program Terms and Conditions shall mean a 24 hour period ending at 11.59pm AEDT;
Any failure or delay by Cycling Couture in exercising its rights under these terms does not constitute a waiver of those rights. Any waiver by Cycling Couture must be in writing and signed by an authorised officer of Cycling Couture.
Nothing in these Loyalty Program Terms & Conditions is intended to contravene any applicable law. To the extent that any provisions in these Loyalty Program Terms and Conditions is invalid or unenforceable, it is to be read down so as to be valid and enforceable, and otherwise must be severed to the extent of any invalidity or unenforceability, without affecting the remaining provisions of these Loyalty Program Terms & Conditions.
Customer Membership to the Loyalty Program
Membership of the Cycling Couture Loyalty Program is open to individuals who are 18 years or older with a unique email address. An individual becomes a Member as at the Join Date.
An individual is deemed to be a Member when they complete a purchase online and or register as a Customer on the Cycling Couture website store. Admission to the Loyalty Program is automatic upon completing the online registration or checkout process.
Any Members who were Customers prior to the Effective Date maybe allocated to a Cycling Couture Loyalty Program at the discretion of Cycling Couture’s authorised representative.
At any time, Members may only have one Customer account to the Cycling Couture Loyalty Program. Members may not transfer their account or Points to another person or email and or Customer Account.
Cycling Couture reserves the right to modify, refuse or terminate a Member’s account to the Cycling Couture Loyalty Program without notice or reason and at its absolute discretion.
A Customer may end their Loyalty Program Membership at any time by Contacting Us.
By joining the Cycling Couture Loyalty Program, an individual consents to Cycling Couture contacting them to provide them with consumer or marketing information and notifying them of Points or other products and special offers.
Earning Cycling Couture Loyalty Points
The Cycling Couture Loyalty Program operates by attributing different Points (as nominated by Cycling Couture from time to time) to the Cycling Couture Loyalty Program.
The conversion rate details attributed for earned Points can be found on the Cycling Couture website. Conversation rates are subject to change at any time without prior notification by Cycling Couture in its absolute discretion.
When a Member completes a transaction online the Website and identifies themselves by logging into their online Customer account, the net amount of the Valid Purchase is added to their My Account Balance on Cycling Couture website, and on the day the order is confirmed via email.
Where a Valid Purchase is made online, Points will be issued based on the day the order is confirmed via email and will be loaded onto the Member’s Customer account within 24 hours.
The currency in which Points are earned will be in AUD, EURO, GBP or NZD, depending on the currency used to complete the online payment at checkout.
Unused Points will expire 180 days after they have been earned.
Cycling Couture will endeavour to notify the Member via email prior to the expiry of any Points.
If a Customer unsubscribes from Cycling Couture Emails their Points balance will remain viewable online only.
At its sole discretion, Cycling Couture may update a Customer’s Member account with a Points as a consequence of a purchasing behaviour, incentive and/or promotional activities.
Cycling Couture reserves the right to withdraw, cancel or vary the Points without notice and at any time for any reason whatsoever in its absolute discretion including without limitation Points awarded in error or Points earned fraudulently.
Points cannot be sold, transferred or assigned and are not redeemable for cash or any other like instruments, including (but not limited to) gift vouchers, gift cards, cheques and credit notes. Points do not represent legal tender in any country.
Points may or may not be earned using other rewards such as promotional Coupons, as part of the transaction.
If a Membership is terminated from the Cycling Couture Loyalty Program, all outstanding and future Rewards will no longer be valid and will be rendered null and void.
When a Customer who is a Member returns a purchase via post, the net amount of the transaction will be deducted from the Member’s Points Balance and the Points that were previously awarded will be adjusted or reversed.
If an online order is cancelled, Cycling Couture may adjust or reverse Points that were previously awarded to a Member in that transaction
Members can view their Points at any time by logging into their Customer My Account online on the Website.
Redeeming Cycling Couture Loyalty Points
Rewards can only been redeemed on the Cycling Couture online store at the time of placing a transaction.
To redeem any applicable Points when transacting online on the Website, a Member must ensure they are logged into a valid Customer account.
When redeeming any applicable Points, the Points will be applied to the online store’s cart as a loyalty redemption discount. A Points balance maybe redeemed in totality or partially..
Points cannot be redeemed in conjunction with any other offer unless otherwise indicated.
All Points have an expiry date as dictated by the date of the original purchase for which the Points where awarded. Cycling Couture reserves the right to change the expiry date of any Points at any time without notice.
Points can only be redeemed once.
Customers who are Members of the Loyalty Program may apply Points to subsequent online purchases. Points maybe applied in part or entirely provided they have not expired.
Cycling Couture reserves the right in its absolute discretion to exclude certain items and promotions from being redeemed by using Points.
